Terms of Service

GOT3D (“GOT3D”, “we”, “us”) is run by 3D My Biz LLC, a California company. These terms are the agreement between you and us when you use got3d.net, the GOT3D app you add to your home screen, and our embeds (together, “GOT3D”). By using GOT3D you agree to them. If you don’t agree, please don’t use GOT3D.
1. Who can use GOT3D
- You must be 13 or older. GOT3D is built for adults; if you are under 18, you need a parent or guardian’s permission, and they agree to these terms for you.
- We don’t knowingly collect information from anyone under 13. If we learn an account belongs to someone under 13, we will delete it. Parents can reach us at myspace@got3d.net.
- One person per account. Keep your password private — you’re responsible for what happens under your account.
- Real estate agents and brokers must enter their own license number. You confirm it’s yours and current; we may check it and remove the agent label if it isn’t.
2. Your content stays yours
You own the tours, spins, photos, text and links you post (“your content”). To run GOT3D you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and share your content; to make share images (“Retro Cards”), QR cards and previews from it; to show it in search, city pages and embeds; and to promote GOT3D with it. The license ends when you delete the content or your account, except for copies others have already embedded or shared, backups kept for a limited time, and anything the law requires us to keep.
3. What you promise about what you post
- You created it or have the right to post it — including any 3D tour, photo, logo or music in it.
- You have permission from the people who appear in it, and from the owner of any private place you captured. Don’t post people who haven’t agreed, and never post minors without their parent or guardian’s permission.
- Listing details (price, beds, license numbers, addresses) are accurate to your knowledge.
- When you hand a tour to its owner, you have the right to give it to them.
4. Not allowed
- Nudity or sexual content, and anything that sexualizes minors — reported to the authorities.
- Harassment, threats, hate, or content that encourages violence or self-harm.
- Illegal activity, weapons or drug sales, scams, spam, or fake accounts, follows or views.
- Other people’s private information (home addresses of private individuals, IDs, license plates in a harmful context).
- Copyright or trademark infringement, and pretending to be someone else or a business you don’t represent.
- Malware, scraping, overloading the service, or getting around our limits or security.
We may remove content, limit features or suspend accounts that break these rules, with or without notice. You can report anything with the Report link on any post.
5. Embeds, sharing and credit
Anyone may embed a public GOT3D tour or spin on their own site using the embed code we provide, free, as long as the GOT3D credit and link stay intact and the embed isn’t used to mislead. Don’t download and re-host someone else’s content without their permission.
6. Leads, jobs and pros
“Find a 3D Pro” connects people with independent photographers and creators. Pros are not our employees or agents. Any job, price, payment or result is between the customer and the pro. Leads are shared first-come, first-served and we don’t guarantee any lead, job or outcome. If we add paid features or payouts, they will have their own terms.
7. Google Maps, tours and other services
Maps, Street View and business details come from Google and are covered by Google Maps Terms and the Google Privacy Policy. Tours hosted by Matterport, Zillow, YouTube and others are governed by their own terms. We aren’t responsible for other services or sites we link to.
8. Copyright complaints
If you believe something on GOT3D infringes your copyright, email myspace@got3d.net with: your contact details; the work you own; the GOT3D link to the content; a statement that you believe in good faith the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for them; and your signature. We remove infringing content and close the accounts of repeat infringers. If your content was removed by mistake, you can send us a counter-notice.
9. Ending things
You can stop using GOT3D at any time and ask us to delete your account at myspace@got3d.net. We may suspend or end accounts that break these terms or put others at risk.
10. Disclaimers
GOT3D is provided “as is” and “as available.” We don’t promise it will be uninterrupted, error-free, or that content posted by others is accurate, legal or safe. To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement.
11. Limits on liability
To the fullest extent the law allows, 3D My Biz LLC and its owners, team and partners are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, data or goodwill. Our total liability for any claim about GOT3D is limited to the greater of $100 or what you paid us in the 12 months before the claim.
12. Your responsibility
You agree to defend and cover 3D My Biz LLC against claims, losses and costs (including reasonable legal fees) that come from your content, your use of GOT3D, or your breaking these terms or the law.
13. The legal stuff
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts in San Diego County, California, and you and we consent to that. If part of these terms can’t be enforced, the rest still applies. We may update these terms; if the changes are important we’ll post a notice or email you, and using GOT3D after that means you accept them.
